We all want to make sure that our employees are behaving themselves. After all they are a representative of our business. Their actions and behavior can reflect badly on our company.
But once again as an employer in California its best to proceed with caution.
There are certain types of employee conduct that cannot be regulated by you the employer. This is especially true of course for activities by the employee during non working hours. But even during working hours where they are under your supervision, there are privacy rights and statutory protections for employees.
Below is a quick cheat sheet of some of the areas you should avoid “going there” with employees. These are some of the most common areas that employers get in trouble with employee ‘protected’ behavior.
