Hello again entrepreneurs of the world, I’m John Fagerholm, and today I want to discuss why it’s so difficult to find a labor defense attorney in California. Well, the short answer is it’s because the money’s on the other side.
You can make a lot more money for a lot less work and a lot less pressure by suing employers because they’re the ones with the money. So, most labor defense attorneys are on the insurance side. There’s insurance, and the insurance company hires them to defend you if you have that type of insurance.
It’s called EPLI insurance, for those of you that want to know, but it doesn’t cover everything. You can have EPLI insurance and still be sued for things that EPLI insurance doesn’t cover.
There’s also another set of attorneys that’ll do anything. They’ll sue you or they’ll defend you. It just depends on what walks into the door. Obviously you don’t want that either.
What makes us special, I’ll say, is because we only defend the employers and we’re not insurance defense, so you don’t need insurance in order to hire us to defend you.
The other question that comes up a lot is if the money’s all on the plaintiff’s side, then why would you defend employers? Well, it’s because I’m an entrepreneur myself.
One thing that I’ve always wanted to be in my life is productive, so I really appreciate productive people. Productive people usually start businesses. Not all of them, but I can say that not all productive people start businesses, but I bet that all people that start businesses are productive people. That’s a good way to put it.
My philosophy is if you’re a productive person, not only are you doing better for your family, but you’re also doing better for your community. You’re hiring people. Whatever. You’re starting these businesses that hire people, that create products for people.
So, I have a love for productive people, which means I have a love for entrepreneurs and I consider myself a productive person, and certainly an entrepreneur myself. So, that’s why I do this side of it.
When I first became an entrepreneur, I started lots of businesses. Some did well. Some didn’t do well. But the ones that did well, at some point I always had to hire people. Once I hired people, that’s when all my problems would start.
That’s what made me realize that, okay I’m already a lawyer. I’ve got these other businesses that I have also. There’s this niche.
There’s this niche of people like me that don’t have anybody to defend them because basically the rules are set up for the most productive people to lose money.
That just didn’t sit well with me, especially once it happened to me. And that people, fellow entrepreneurs and fellow productive people, is why I do what I do.
