Since day one of practicing Employment Law my focus has been on helping Employers only.
I saw from the very start that the entire system had shifted to vilifying business owners and blaming us for every workplace problem.
Of course employment laws should be in place and employees should have rights that help keep them from being taken advantage of.
But the same holds true for employers. We need protections as well. After all we are entrepreneurs who are taking all the risk!
But for awhile it was pretty lonely. I felt like I was the only one publicly speaking out about these policies that have made owning a business so difficult in California. It seemed like no one wanted to listen. They want to cling to the perceived notion of the ‘evil’ employer and the ‘defenseless’ employee, even if some cases were clearly not that.
I wanted to expose the fact that this has created a climate of fear and uncertainty for California employers and that some unscrupulous employees and their lawyers are looking to take advantage of the situation. There are people out there who basically look to exploit the system and blackmail employers using the unfair labor laws as their leverage.
Well after all this time on my soapbox I finally feel like our message is starting to stick!
People are finally starting to realize that this situation is bad for California employers, which is bad for California business and in turn bad for the California economy!
California is Losing Business
Don’t believe me? Just look at all the big companies that have abandoned California recently. These companies are not only leaving because of the high taxes but the crazy out of control regulations!
You don’t have to look any further than the Autozone case to see how out of control things are where they lost a judgement of almost $200 million dollars in an employee case! (the store the lawsuit came from was San Diego)
If you own a company or operate in California with employees you now have to factor in that outrageous risk.
Anyway I could go on for days and give dozens of outrageous examples like this. But let me get back to the point. That yes people are finally starting to listen!
The good news is I have been getting more requests to speak about employer defense and the steps business owners can take to help protect their companies from these types of ridiculous labor verdicts.
