What’s up fellow entrepreneurs today. I want to talk about a third COVID-19 vaccine paid leave covering Los Angeles area employers. But first I’m an attorney, but I’m not your attorney. So please find competent legal counsel for your specific question or concerns.
On June 24th, the city of Los Angeles issued an emergency order, extending COVID-19 vaccine paid sick leave through September 30th. There’s a lot here. So let me break it down in bullet points.
First effect, the effective period is until September 30th, 2021 eligible employees are those employees that perform work within the geographic boundaries of the city of Los Angeles and have been employed by the same employer for 60 days for at least 60 days.
So the amount of the leave is up to four hours of paid leave and eight hours of recovery to full-time employees for companies with 25 or fewer employees and employers with 26 or more employees are only required to provide the paid leave to employees who have exhausted their leave under California’s or the city of Los Angeles is supplemental paid sick leave.
Verification employers are permitted to ask employees to provide written verification of receipt of a COVID-19 vaccine to receive payment for the leave the relationship with other leave.
The paid leave is an addition to any other paid leave available to an employee and employer cannot require an employee to use other paid or unpaid leave prior to using the backseat paid sick leave retroactive.
Yes, the paid leave is retroactive to January 1st, 2021. Meaning an employer must provide retroactive paid leave to employees who took time off work to receive a COVID-19 vaccination or recover from a vaccination side effects upon request.
