I get this question a lot, and it’s such an easy answer. The question is, when do I have to pay overtime?
You have to pay overtime anytime one of your employees works over eight hours in a day, or over 40 hours in a week.
So for example, if your employee worked 10 hours on Wednesday, then that’s two hours of overtime for Wednesday.
It doesn’t matter if they only worked 30 hours that week in total, because they worked 10 hours on Wednesday, it’s two hours of overtime.
Now, what about if your client only works six hours a day?
Well, if it’s six hours a day, and it was over 40 hours in a week, then depending if they worked more than five days, if it’s over 40 hours in a week, then you have to pay overtime for every hour over 40 hours.
